1. Introduction
These Terms and Conditions ("Terms") govern your use of the internet services provided by Mtech Internet Services (Pty) Ltd ("Mtech", "we", "us", or "our"). By signing up for our services, you agree to be bound by these Terms.
2. Service Description
Mtech provides fixed wireless internet connectivity in selected coverage areas within South Africa. Service availability depends on your location falling within one of our active coverage zones.
- Service is subject to coverage verification at the time of signup.
- Advertised speeds are "up to" speeds and may vary based on network conditions, distance from the tower, and the number of active users.
- We reserve the right to manage network traffic to ensure a fair experience for all users.
3. Activation & Payment
- A once-off activation fee of R500 is payable at the time of signup.
- Monthly subscription fees are billed in advance and are due on the same date each month as your activation date.
- Payments are processed securely via our third-party payment provider (Paystack). Mtech does not store your card details.
- Installation is provided free of charge within our standard coverage areas.
- If payment fails or is overdue by more than 7 days, your service may be suspended until the outstanding amount is settled.
- Payments made past the agreed and recorded payment date will be treated as a late payment. A late payment does not reset or shift your billing cycle — your service period still runs from your original billing date to the next 30-day cycle.
4. Installation & Equipment
- Mtech provides and installs all required equipment, including a standard outdoor antenna and indoor router unit. All equipment remains the sole property of Mtech.
- Installation is provided free of charge within our standard coverage areas. Installation timelines are subject to technician availability, coverage confirmation, and completion of all required documentation.
- You are responsible for ensuring safe access to your property for installation and maintenance.
- You are responsible for the safekeeping of all Mtech equipment installed at your premises for the duration of your service.
- Upon termination of service, all equipment must be returned in good working condition or in a refurbished/serviceable state. Damaged, missing, or unreturned equipment may incur a replacement charge.
5. Acceptable Use
You agree not to use our service for any unlawful purpose, including but not limited to:
- Distributing malicious software or engaging in hacking activities.
- Sending spam or bulk unsolicited communications.
- Accessing or distributing illegal content.
- Reselling or redistributing the service without written consent from Mtech.
Violation of this policy may result in immediate suspension or termination of service without refund.
6. Service Level & Downtime
- We aim to maintain maximum uptime, but cannot guarantee uninterrupted service.
- Planned maintenance will be communicated in advance where possible.
- We are not liable for service interruptions caused by factors beyond our control, including severe weather, power outages, or third-party infrastructure failures.
7. Cancellation
- You may cancel your service by giving 30 days' written notice.
- The activation fee is non-refundable.
- Any outstanding balance must be settled before cancellation is processed.
- Equipment collection will be arranged at a mutually convenient time.
8. WhatsApp Communications
By signing up for Mtech services or contacting us via WhatsApp, you consent to receiving communications from Mtech through the WhatsApp Business API, including:
- Order confirmations and payment receipts
- Installation scheduling and status updates
- Service notifications (outages, maintenance, account alerts)
- Customer support messages
- Promotional offers (you may opt out of these at any time)
Message frequency varies based on your account activity. Standard data rates from your mobile provider may apply.
You may opt out of WhatsApp messages at any time by replying STOP. Opting out does not affect your internet service or your ability to contact us via other channels.
WhatsApp messages are delivered through Meta Platforms, Inc. By using our WhatsApp channel, you also agree to WhatsApp's Terms of Service.
9. Limitation of Liability
To the maximum extent permitted by law, Mtech shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services, including loss of data or business interruption.
10. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on our website and take effect immediately. Continued use of the service after changes constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
